These Terms and Conditions (“Terms”) govern your use of the AcePick mobile application (“the App”) provided Acepick Networking Company (“the Company”). By accessing or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, please refrain from using the App.

1. Eligibility

1.1 You must be at least 18 years old to use the App. By using the App, you represent and warrant that you are of legal age and have the legal capacity to enter into these Terms.

2. Use of the App

2.1 Account Registration: To use certain features of the App, you may be required to register for an account. You are responsible for maintaining the confidentiality of your account information and for all activities that occur under your account.

2.2 Access and Usage: AcePick is a platform that connects clients with professionals across various sectors. Users may access and use the AcePick app solely for the purpose of browsing, searching, communicating with professionals, and hiring services offered by professionals listed on the platform.

2.3 Hiring Process: AcePick facilitates direct communication and agreements between clients and professionals. Clients can browse professional profiles, initiate chats, negotiate terms, and hire professionals based on their specific needs.

2.4 Marketplace: allows users to display prices of items and browse businesses selling specific items. While Acepick facilitates these transactions, we do not guarantee the accuracy of prices or the quality of items listed in the Marketplace. Users are solely responsible for their transactions in the Marketplace.

2.5 No Job Posting: Please note that AcePick does not provide a feature for users to post job listings. Instead, it is designed to streamline the process of finding and hiring professionals directly. Therefore, users are not permitted to post job listings or requests on the platform.

2.6 Screening, Verification, and Conflict Resolution

AcePick is committed to ensuring the reliability and competence of professionals listed on our platform. We take proactive measures to verify the credentials and qualifications of professionals, making them traceable and contactable for both clients and professionals. Our goal is to facilitate secure and trustworthy transactions between clients and professionals. Here’s how it works:

1. Verification Process: AcePick conducts a thorough verification process for professionals. This includes verifying their qualifications, certifications, licenses, and relevant background information. Professionals are required to provide accurate and up-to-date information during registration.
2. Traceability: Clients can easily trace and contact professionals through our platform. All communications, agreements, and job-related discussions can take place within AcePick’s secure environment.
3. Price Agreement: AcePick encourages clients and professionals to arrive at a mutually agreed-upon price for the services to be rendered. This ensures transparency and clarity in the financial aspects of the transaction.
4. Voice Recorder Feature: AcePick provides a voice recorder feature that allows clients and professionals to record conversations during physical meetups related to work. These recordings are automatically sent to the server and stored securely. This feature is designed to assist in conflict resolution if disputes arise between clients and professionals.
5. Reliability: By using AcePick, clients can have confidence in the reliability and competence of the professionals they choose to hire. We strive to maintain a community of trustworthy professionals.
6. Client Responsibility: While AcePick plays a role in screening and verifying professionals, clients also have a responsibility to engage in open and constructive communication with professionals, negotiate terms, and ensure that the agreed-upon work aligns with their requirements.
7. Discussions Outside AcePick: It is essential to note that any discussions, biddings, projects, or payments conducted outside the AcePick platform are not the responsibility of AcePick. If clients and professionals choose to engage in such discussions or transactions independently, AcePick will not be responsible for any disagreements, disputes, or payment issues that may arise as a result.

AcePick aims to provide a secure and efficient platform for clients and professionals to connect, collaborate, and enter into agreements with confidence. The voice recorder feature is an additional tool to assist in conflict resolution when needed.

3. Payment and Fees

3.1 Transaction Fees: The Company may charge fees for certain services, which will be clearly communicated to users.

3.2 Billing and Payments: Payments made through the App are processed by secure payment gateways. The Company does not store payment card details.

4. Escrow System Agreement

4.1 Escrow Service: The App offers an escrow service for payments related to projects. In an escrow transaction, funds are held securely until certain conditions are met.

4.2 Escrow Process:

• Upon agreement between the client and professional or corporate body, funds for a project are placed in escrow.
• Funds held in escrow are disbursed to the professional or corporate body upon completion of project milestones or deliverables, subject to the agreement between the parties.
• The escrow process provides a secure mechanism for holding funds until both parties agree that the project’s requirements have been met.

5. Dispute Resolution

5.1 Disputes: In the event of a dispute between a client and a professional or corporate body, the App provides a comprehensive dispute resolution process to assist in resolving conflicts.

5.2 Mediation: Disputing parties may choose to engage in mediation facilitated by the App to reach a mutually agreeable resolution. Mediation is a voluntary process and does not result in binding decisions.

5.3 Arbitration: If mediation is unsuccessful or not chosen by the parties, disputes may be resolved through binding arbitration in accordance with the rules and procedures established by the App. The decision of the arbitrator is final and binding.

6. Governing Law

These Terms are governed by the laws of the Federal Republic of Nigeria.

7. Termination

The Company reserves the right to suspend or terminate your account and access to the App at its sole discretion, with or without cause and with or without notice.

8. Changes to Terms

The Company may modify these Terms at any time. Users will be notified of any changes, and continued use of the App after modifications constitutes acceptance of the updated Terms.

9. Disclaimer of Warranties

The App is provided “as is” and “as available” without warranties of any kind, either express or implied, including, but not limited to, the implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

10. Limitation of Liability

The Company is not liable for any direct, indirect, incidental, special, or consequential damages arising from the use of the App or inability to use the App.
